4. Product Information

4.1 Representation

Product images displayed on the Seller's website are for illustration purposes only. Actual Products may differ slightly in appearance from the images shown. The Seller strives to ensure accuracy but cannot guarantee an exact match due to variations in manufacturing, natural materials, and screen display settings.

4.2 Availability of Information

On request, DIY Building Supplies Limited can provide access to product specifications, technical data sheets, safety data sheets (SDS), and installation guides (collectively, "Product Documentation") where available. This Product Documentation is intended to provide detailed information about the Products, including their characteristics, performance, handling, and application. All Product Documentation, including that provided on the DIY Building Supplies Ltd website, is supplied by the respective manufacturers or Suppliers.

4.3 Customer Responsibility

It is the sole responsibility of the Customer to review and understand all relevant Product Documentation prior to purchase, installation, or use of the Products. This includes, but is not limited to, ensuring the Product is suitable for the Customer's intended application, understanding any specific handling or safety requirements, and complying with all recommended installation procedures.

4.4 Accuracy and Interpretation

While the Seller endeavors to ensure the Product Documentation displayed or linked on the Seller's website is current and accurate, DIY Building Supplies Limited relies on the information provided by the manufacturers and Suppliers. The Seller does not warrant the absolute accuracy, completeness, or suitability of any Product Documentation. The interpretation and application of Product Documentation remain the responsibility of the Customer, and professional advice should be sought where necessary.

4.5 No Liability for Misinterpretation/Misuse

DIY Building Supplies Limited shall not be liable for any loss, damage, injury, or expense arising from the Customer's failure to consult, properly understand, or correctly apply the information contained within the Product Documentation, or from any misuse or incorrect installation of the Products based on such documentation.

5. Ordering and Delivery

5.1 Order Confirmation

Upon placing an order, DIY Building Supplies Limited will send an order confirmation to the Customer. The Customer will subsequently receive information relating to the delivery of the  order. Whilst the Customer's order may be delivered directly from a third-party Supplier, DIY Building Supplies remains the Customer's point of contact. If the Customer needs to make contact regarding the Customer's order, they should do so by email or phone.

5.2 Delivery Times

Delivery for all Products, with the exception of paving and sheds, is typically 3-5 working days. However, this is not guaranteed. This timeframe is based on orders being placed before 2 PM BST. Orders placed after 2 PM BST may experience an additional day for processing. The Seller will endeavor to keep the Customer informed of the order status and, where given, an expected delivery date or tracking information.

5.3 Delivery Charges and Delays

All quoted delivery prices are for most UK Mainland addresses. The following areas may not be serviced or will incur additional charges and may also experience delivery delays:

  • Northern Ireland (BT postcodes), Isle of Wight (PO30-37 postcodes), Isle of Man (IM postcodes), Scottish Highlands and Orkney Isles (PA, ML, EH, KA, G, KY, PH, DD, AB, IV, KW postcodes), Outer Hebrides and the Shetland Isles (HS, ZE postcodes)

Please contact the Seller for a specific delivery quote if the Customer's address falls within these areas.

5.4 Delivery Procedures

Delivery procedures are primarily at the discretion of the individual delivery driver and are subject to the policies of the specific Supplier delivering the goods.

  • Convenience Requests: While the Seller can communicate requests for the most convenient delivery times or methods to the Supplier, these are requests only and cannot be guaranteed. The Supplier's standard delivery schedules and routes will apply.

  • Kerbside Drop: Bulk deliveries are made on a kerbside drop basis. This means the delivery vehicle will park as close as legally and safely possible to the Customer's property, and the goods will be offloaded to the nearest safe and accessible point on the public highway or the Customer's kerbside. The driver is not obligated to move goods beyond this point, into the Customer's property, or up pathways. Requests made to the driver are at the driver’s discretion and will adhere to the policy of the company carrying out the delivery.

  • Leaving Goods on Property: If, in the driver's assessment, it is safe and legal to do so, and there is no person present to accept the delivery, goods may be left on the Customer's property (e.g., driveway, front garden) at the driver's discretion. This is done to facilitate delivery and avoid delays. If the Customer does not wish for goods to be left on the Customer's property without a signature, they must expressly state this upon ordering. Failure to do so implies acceptance of this possibility.

  • Customer Responsibility for Access: It is the Customer's sole responsibility to ensure and communicate any access issues that may affect delivery. This includes, but is not limited to, narrow roads, weight restrictions, low bridges, overhanging trees, overhead power cables, steep inclines, or any other obstacles that might prevent a large delivery vehicle (often an articulated lorry or large rigid truck) from reaching or safely offloading at the delivery address. Failure to notify the Seller of such access issues at the time of ordering, resulting in an aborted or delayed delivery, may incur additional charges (e.g., re-delivery fees, storage fees, or return charges).

5.5 Rejection of Delivery

The Customer may reject delivery of a Product at the point of delivery if there is visible and significant damage to the packaging or the Product itself, or if the delivered items are clearly incorrect as per the Customer's order.

To reject delivery:

  • The Customer must clearly inform the delivery driver of the refusal to accept the goods, noting the specific reason for rejection (e.g., "damaged packaging," "product broken," "wrong item").

  • Where possible, ask the driver to make a note on their delivery manifest or acquire a signed document from the driver confirming the rejection and the reason.

  • The Customer must then immediately notify DIY Building Supplies Limited by emailing or calling within 24 hours of the attempted delivery, providing the order number and details of the rejection.

Upon valid rejection due to damage or incorrect items, the Seller will work with the Supplier to arrange a replacement delivery or a refund, as deemed appropriate. Please note that unjustified rejection of delivery may incur additional delivery or restocking charges.

5.6 Third-Party Delivery Liability

Please note that many Products sold by DIY Building Supplies Limited are delivered directly from the Seller's Suppliers, utilising their own transport or independent third-party carriers. While DIY Building Supplies Limited will use reasonable care in selecting Suppliers and arranging delivery, the Seller is not the direct carrier of the Products.

DIY Building Supplies Limited's liability for delays, damage, or other issues occurring during transit by a third-party carrier or Supplier's own transport is limited. The Seller will act as an intermediary to resolve delivery issues with the Supplier and/or carrier on the Customer's behalf, in accordance with the Seller's "Product Inspection, Damages, and Acceptance of Quality" policy (Section 7). However, the Seller shall not be directly liable for any acts, omissions, negligence, or delays of any third-party carrier or Supplier's own transport beyond the Seller's reasonable control. Any claim for direct damages or issues caused by the carrier's negligence or conduct during transit remains ultimately with the carrier or Supplier, though the Seller will assist in facilitating such claims where appropriate.

Risk of loss or damage to the Products shall pass to the Customer upon successful delivery of the Products to the agreed delivery address.

5.7 Courier Delivery

We use couriers to deliver some of our products. Once tracking information is provided to you via email, it becomes your responsibility to use this information to monitor and manage the delivery of your order, including checking the expected delivery time and status.

Due to the value and nature of the materials, all deliveries may require a signature upon receipt. It is your responsibility to ensure that a person is present at the delivery address to inspect and sign for the goods. Failure to receive and sign for the goods may result in the consignment being returned to the depot and could incur re-delivery charges.

The carrier’s signed Proof of Delivery (PoD) or photographic evidence taken by the driver will constitute conclusive proof that the delivery has taken place as arranged and that the risk of loss or damage to the Products has passed to you

6. Customer Collections

6.1 Collection Arrangement

Where the option for customer collection is made available by DIY Building Supplies Limited, this must be pre-arranged and confirmed with the Seller in writing. Collections will only be permitted from the specified collection point (e.g. Supplier warehouse) during agreed collection times. Collections will only be possible with a valid collection reference provided by DIY Building Supplies Limited.

6.2 Collection Fee

A collection fee is applicable to cover administrative costs or handling charges associated with preparing goods for collection. Any such fee will be communicated to the Customer prior to finalising the collection arrangement.

6.3 Order Amendments at Collection Point

To ensure efficiency and accuracy, no additions or amendments can be made to the Customer's order at the collection point. The Customer's order must be finalised and confirmed prior to the Customer's arrival for collection.

6.4 Additional Purchases at Collection Point

Should the Customer choose to purchase additional items directly from the Supplier at the point of collection, this will constitute a separate and independent transaction solely between the Customer and the Supplier. All monies for such additional items must be paid directly to the Supplier. Such additional purchases are not facilitated by or connected to DIY Building Supplies Limited and are therefore not covered by these Terms and Conditions. Any claims, returns, warranties, or disputes related to these additional items must be raised directly with the Supplier.

6.5 Rejection at Collection

The Customer has the right to inspect the goods at the point of collection. If there is visible and significant damage, or if the collected items are clearly incorrect or incomplete as per the order, the Customer may reject the collection of those specific goods. The Customer must clearly communicate the reason for rejection to the Supplier's staff or the person overseeing the collection. If the Supplier cannot directly resolve the issue, the Customer must then immediately notify DIY Building Supplies Limited by emailing or calling within 24 hours of the attempted collection, providing the order number and details of the rejection.

6.6 Responsibility for Safe and Legal Loading and Transit

It is the Customer's sole responsibility to safely and legally load all Products onto the Customer's vehicle or a vehicle arranged by the Customer at the collection point. This includes ensuring:

  • The vehicle is suitable and legally capable of carrying the weight and dimensions of the Products.

  • The Products are securely and safely loaded and restrained to prevent movement, damage, or hazard during transit.

  • The Customer complies with all relevant road traffic regulations, including vehicle weight limits, safe loading practices, and driver licensing requirements.

DIY Building Supplies Limited nor the Supplier takes any responsibility or liability for any injury, death, loss, or damage sustained by any person or property whilst loading Products into a vehicle at the collection point.

Should the Customer wish for the Supplier's staff to assist with loading Products onto the Customer's vehicle, such assistance is provided strictly at the discretion of the Supplier and in accordance with their internal health and safety policies and procedures. Any assistance provided does not transfer the ultimate responsibility for safe loading, which remains with the Customer.

DIY Building Supplies Limited and the Supplier shall not be liable for any damage, loss, injury, or penalties incurred during the transit of goods once they have been loaded at the collection point.

6.7 Risk Transfer upon Loading

Risk of loss or damage to the Products shall pass to the Customer immediately at the point of acceptance at the collection point. Therefore, it is essential that the Customer immediately and thoroughly check all products at the collection point. This inspection must verify the quantity, type, and condition of all items against the Customer's order/collection confirmation.

7. Product Inspection, Damages, and Acceptance of Quality

7.1 Immediate Inspection Upon Receipt

Upon receipt of the Customer's order, it is the Customer's responsibility to immediately inspect all Products thoroughly within 24-hours of delivery or immediately at the point of collection. This inspection must verify the quantity, type, and condition of all items against the Customer's dispatch confirmation.

7.2 Reporting Damages, Faults, or Discrepancies

If the Customer receives an order and one or more of the Customer's items are faulty, damaged, incorrect, or if there are any discrepancies with the Customer's order, this must be reported within the inspection period.

Inspection Period: Immediately at the point of collection or within the 24-hour inspection period from the time of delivery.

Failure to notify DIY Building Supplies Limited within this window may result in the claim being rejected.

To report any issues, please email or call with the following information: The order number, item(s) affected or incorrect, number of affected/incorrect items.

The Customer is responsible for ensuring they have clear photographic evidence of affected items. Please attach these to any email communication, where applicable. An assessment of the complaint may not be made without these.

7.3 Acceptance of Quality

The Customer's commencement of the use of any Product, or the Customer's failure to report any damages, faults, or discrepancies within the inspection period, shall constitute the Customer's conclusive acceptance of the Product's quality, condition, and conformity to the Customer's order. Once a Product has been used, or the inspection period has passed without reported issues, DIY Building Supplies Limited will consider the Product to have been accepted as fit for purpose and in good condition.

7.4 Resolution of Reported Issues

Once a valid report of damages or faults has been received within the inspection period, the Seller will aim to exchange the Customer's items as soon as possible. Usually, this is within 2-3 working days. However, this timeframe may be subject to change based on stock availability and Supplier lead times. On some occasions, the Seller may offer a full or partial refund, but this will be reviewed upon the assessment of the supporting evidence provided.

7.5 Product Alternatives

In rare circumstances, an alternative brand or product may be supplied if the original specified brand is unavailable. The Seller will endeavor to notify the Customer ahead of time if such an alternative is provided. Product alternatives offered will be of equal or higher value and specification. Should the only Product alternative be of a lower value or specification, the Seller will notify the Customer of this and, if the Customer can accept this, the Seller will refund the difference.

It is the responsibility of the customer to ensure that the Product alternative offered is fit for purpose. Once a Product has been used, or the window to report issues (immediately for collection or within 24-hours for delivery) has passed without reported issues, DIY Building Supplies Limited will consider the Product to have been accepted as fit for purpose.

7.6 Cut-to-Size Sheet Material Terms

The Good Sheet Materials Limited provides a cut-to-size service for sheet materials. Cuts are made using a well-maintained wall saw to provide accurate, clean results.

Cutting Tolerances: Standard tolerance is ±3mm. Variations within tolerance are considered acceptable and not grounds for return, refund, or replacement.

Standard vs. Premium Finish: Standard cuts are suitable for most applications.
A premium finish on both sides must be requested in advance, as it requires a different process and may incur additional charges.

Non-Returnable Service: Cut-to-size or customised items are non-returnable unless faulty, damaged, or not supplied as ordered.

8. Order Amendments and Cancellations

8.1 Amending Your Order

If the Customer wishes to amend their order, please contact the Seller as soon as possible by phone or email. The Seller will do their best to accommodate the Customer's request, but please note that amendments may not be possible if the order has already been processed or dispatched by the Supplier. All amendments are made through DIY Building Supplies Limited. Any amendments made directly with the Supplier are not facilitated by or connected to DIY Building Supplies Limited and are therefore not covered by these Terms and Conditions. Any claims, returns, warranties, or disputes related to these amendments must be raised directly with the Supplier.

8.2 Cancelling Your Order

To cancel the Customer's order, please do so as soon as possible by telephone or email detailing the Customer's order number. Cancellations are subject to the stage of order processing and may incur charges if the order has already been dispatched or a restocking fee applies.

8.3 Timeframe

When cancelling or amending your order, please be aware that orders are processed in 1-2 working days from order. Emails are not classed as an instant form of communication and these can take up to 2 working days for a response. Therefore, it is recommended that you call within opening hours to amend or cancel your order.

Amendments and cancellations are only confirmed when the Customer has received written confirmation from DIY Building Supplies Ltd.

9. Returns and Refunds Policy

If you wish to initiate a return or refund, please contact us straight away. Email: support@diybuildingsupplies.co.uk Telephone: 0115 6976 800 (during the Seller's opening hours)

9.1 Right to Cancel (Change of Mind)

  • Notification Period: As a Customer purchasing online, the Customer has a statutory right to cancel the Customer's order for any reason within 14 calendar days from the day after the Customer (or a person identified by the Customer) receives the last item of the Customer's order.

  • How to Cancel: To exercise the Customer's right to cancel, they must clearly inform the us of the decision within this 14-day period by email or telephone, giving the order number and clear information about the Products for return and reasons for doing so

  • Return Period: Once the Customer has notified the Seller of the Customer's cancellation, the Customer then has a further 14 calendar days to ensure the goods are returned safely to the Supplier.

  • Cost of Return: Unless the goods are faulty, damaged, or incorrect, the Customer is responsible for the direct cost of returning the goods to the Supplier. Please consider postage and shipping times when returning goods to ensure they reach the Supplier within the 14-day return period by the method outlined by DIY Building Supplies Limited. DIY Building Supplies Limited is not liable for postage, shipping, or taxes due on returned goods. However, we will assist the Customer in returning the goods via the Supplier where possible.

  • Refund of Delivery Costs: Upon a valid cancellation, we will refund the cost of the Products and the standard delivery charge the Customer paid for the original delivery minus any charges incurred as outlined below.

9.2 Exclusions from the Right to Cancel

Please note that the 14-day "change of mind" right to cancel under the Consumer Contracts Regulations 2013 does not apply to certain types of Products, including:

  • Products that are made to the Customer's specific order, personalised, or clearly customised to the Customer's requirements (e.g., timber cut to specific lengths, materials cut to size, bespoke manufactured items).

  • Products that are perishable or have a short shelf-life, such as, but not limited to, plaster, cement, and bulk bags.

  • Products that become inseparably mixed with other items after delivery (e.g., certain aggregates once applied).

For such excluded Products, returns or exchanges will only be accepted if the Product is faulty, damaged, or not as described.

9.3 Condition of Returned Goods and Deductions

  • Condition: All returned goods (under the change of mind policy) must be returned in perfect, unused, and resalable condition, in their original packaging (if applicable), and accompanied by the relevant order confirmation.

  • Deductions for Diminished Value: A deduction may be made from the Customer's refund if the value of the goods has been reduced as a result of unnecessary handling by the Customer (i.e., handling them more than would be necessary to establish their nature, characteristics, and functioning, as the Customer would reasonably do in a shop). For building materials, this may include, but is not limited to, signs of use, damage, cutting, alteration, exposure to adverse weather, or removal from original packaging in a way that prevents resale.

  • Restocking Charges: For certain Products that are returned under a "change of mind" policy and require special handling or cannot be easily re-sold, a manufacturer’s restocking charge may apply. This charge, which may be up to 30% of the purchase price, will be deducted from the Customer's refund. The Customer will be notified of this amount when the Customer requests a refund or exchange. This charge reflects the diminished value and specific costs associated with handling such returns.

9.4 Faulty, Damaged, or Incorrect Goods

  • Customer's Rights: The Customer's statutory rights under the Consumer Rights Act 2015 state that goods must be of satisfactory quality, fit for purpose, and as described.

  • Reporting Issues: If the Customer receives goods that are faulty, damaged, or incorrect, this falls under the Seller's "Product Inspection, Damages, and Acceptance of Quality" policy detailed in Section 7. The Customer must report these issues within the inspection period to be eligible for a replacement or refund.

  • Resolution: For valid claims, DIY Building Supplies Limited will work to provide a replacement, repair, or refund in accordance with the Customer's statutory rights and the Seller's policies. In such cases, DIY Building Supplies Limited will arrange and cover the cost of collection or return of the faulty, damaged, or incorrect goods.

9.5 Refund Processing

Refunds will be processed promptly once the returned goods have been received and inspected by the Supplier, or once proof of return has been provided. Refunds will be processed on the same day as approval but may take 2-3 business days for the Customer's bank to return the funds to the Customer's account.

The Seller (DIY Building Supplies Limited or the Supplier, as applicable) shall not be liable to the Buyer or be deemed to be in breach of the contract by reason of any delay in performing, or any failure to perform, any of the Seller’s obligations in relation to the goods, if the delay or failure was due to any cause beyond the Seller’s reasonable control. Without prejudice to the generality of the foregoing, the following shall be regarded as causes beyond the Seller’s reasonable control:

11. Limitation of Liability for Consequential Loss

11.1 Customer's Responsibility for Mitigation

It is the Customer's sole responsibility to ensure that reasonable arrangements are made to minimise the potential impact of things going wrong during their projects or construction activities. This includes, but is not limited to, ordering Products well in advance of their required use, allowing for potential delays in delivery, and making alternative arrangements where the timely and perfect arrival of materials is critical. Should issues arise, the Customer is expected to take all reasonable steps to minimise any resulting impact, whether financial or otherwise.

11.2 Extent of DIY Building Supplies Limited's Liability

DIY Building Supplies Limited shall exercise all reasonable endeavours to ensure the accurate and timely fulfilment of customer orders. However, notwithstanding such efforts, and for matters beyond the Seller's reasonable control, DIY Building Supplies Limited shall not be liable for any indirect, incidental, special, punitive, or consequential losses, damages, or expenses howsoever arising (including without limitation loss of profits, loss of business, loss of anticipated savings, depletion of goodwill and/or similar losses), whether caused by tort (including negligence), breach of contract or otherwise, which arise out of or in connection with the supply of the Products or their use by the Customer. This includes, but is not limited to, financial losses incurred due to delayed delivery, damaged goods requiring replacement, or any unforeseen issues that may arise during or after the purchase and use of the Seller's Products, where such issues are not directly attributable to the Seller's breach of contract or negligence.

11.3 Total Liability Limit

The Seller's total liability in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise, arising in connection with the performance or contemplated performance of this Agreement shall be limited to the price paid for the Product.

11.4 Non-Excludable Liability

Nothing in this Agreement or in these Terms and Conditions shall operate to exclude or limit the Seller's liability for: (a) death or personal injury caused by the Seller's negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability which cannot be excluded or limited under applicable law.

12. Gestures of Goodwill

12.1 Discretionary Action

Any action taken by DIY Building Supplies Limited or a Supplier that goes beyond the strict requirements of these Terms and Conditions, or beyond the Seller's statutory obligations, shall be considered a gesture of goodwill. Such gestures are made entirely at the Seller's discretion and are intended to enhance customer satisfaction.

12.2 No Admission of Liability

A gesture of goodwill does not constitute an admission of liability, fault, or negligence on the part of DIY Building Supplies Limited or the Supplier.

12.3 No Precedent or Waiver

A gesture of goodwill in one instance does not establish a precedent for future actions or similar situations. It does not waive any of the Seller's rights or the Supplier's rights under these Terms and Conditions, nor does it amend, vary, or modify the terms of this Agreement in any way, unless explicitly agreed upon in writing.

12.4 Not a Contractual Right

The Customer acknowledges that they have no contractual right to demand or expect any gesture of goodwill, and any such gesture is offered without prejudice to the Seller's standard Terms and Conditions.
